Banyak pertanyaan sekitar keputusan Pengadilan Tinggi Jawa Barat yang memenangkan gugatan pasangan Badrul Kamal-Syihabuddin Ahmad dari Partai Golkar dalam pemilihan Wali Kota Depok. Putusan ini menganulir kemenangan pasangan Nurmahmudi Ismail-Yuyun Wirasaputra dari Partai Keadilan Sejahtera yang sebelumnya ditetapkan Komisi Pemilihan Umum Daerah Kota Depok.

Putusan tersebut bersifat final sesuai dengan Undang-Undang Nomor 32 Tahun 2004 tentang Pemerintahan Daerah. Artinya, putusan tersebut telah berkekuatan hukum tetap dan karena itu tidak dapat diajukan banding, kasasi, ataupun peninjauan kembali terhadapnya.

Pengadilan Tinggi Jawa Barat mengeluarkan putusan itu sebagai “wakil” Mahkamah Agung yang telah mengeluarkan Peraturan MA Nomor 2/2005 bahwa semua sengketa yang berkaitan dengan pemilihan kepala daerah diputuskan hanya sampai tingkat pengadilan tinggi.

Meskipun sifatnya final, ada beberapa hal yang perlu mendapat penjelasan. Apalagi putusan Pengadilan Tinggi Jawa Barat ini merupakan putusan sengketa hasil pilkada pertama yang memenangkan pemohon. Belum ada preseden hukum dalam kasus pilkada ini.

Dalam amar putusannya, misalnya, majelis hakim mengambil kesimpulan berdasarkan asumsi yang diajukan termohon dan bukan alat bukti. Majelis meyakini bahwa pemohon, Badrul Kamal, kehilangan sekitar 60 ribu suara. Membuktikan hilangnya suara sebanyak itu tidaklah mudah dan tak sederhana. Pengecekan harus dilakukan di lapangan dan tak bisa dikerjakan dari balik meja kerja sambil membolak-balik timbunan kertas. Mendasarkan putusan pada laporan satu pihak bisa mendatangkan masalah, juga ketidakpuasan yang luas. Kurang dalamnya penelitian di lapangan bisa berakibat luas dan sukar direhabilitasi mengingat sifat putusan yang final itu.

Dampak politik putusan ini cukup serius. Dengan dikabulkannya gugatan pemohon, secara tidak langsung dianggap telah terjadi kecurangan dalam pilkada Depok. Kecurangan itu, bila benar ada, tentu dilakukan oleh salah satu pasangan calon dan ini perlu diusut.

Tentu Pengadilan Tinggi Jawa Barat mempunyai argumentasi. Maka, agar tidak timbul bermacam kecurigaan, disarankan agar Mahkamah Agung dan Komisi Yudisial meneliti proses persidangan ini. Jika kelak semua prosedur dinyatakan benar, putusan majelis hakim Pengadilan Tinggi Jawa Barat perlu dijadikan preseden berharga dalam ajang pilkada ini.

Sebaliknya, bila dalam pembuatan putusan ditemukan adanya kesalahan prosedur, kelalaian, atau pelanggaran hukum, Mahkamah Agung atas rekomendasi Komisi Yudisial perlu segera mengeluarkan pengumuman. Hasil pilkada Depok mungkin tak bisa diubah lagi, tapi apa yang terjadi di Depok bisa diharapkan tidak terulang di daerah lain. ***
